1. Terms of Service
- Who registers. A parent or legal guardian must register any athlete under 18 and is responsible for the information provided and for this agreement. An athlete who is 18 or older registers on their own behalf.
- Sessions. Plans cover coached sessions per month (Plan 2 Days: 8, Plan 3 Days: 12, Plan 5 Days: 20). Single Practice covers one session. Unused monthly sessions do not roll over. Sessions are scheduled with the coaching staff.
- Instruction only. Fees are charged exclusively for professional baseball instruction. Athletes may be on the training field or facility only during their scheduled coached session; the plans do not include open or unsupervised use of any field, equipment or facility.
- Health and fitness. The parent/guardian (or the athlete, if 18+) must tell us about any injury, illness or condition that may affect training and should consult a physician when in doubt. Coaches may modify or stop any activity for safety. Our staff provide athletic coaching and conditioning, not medical advice or treatment.
- Supervision and pick-up. We supervise athletes only during scheduled sessions. Parents/guardians are responsible for dropping off and picking up athletes on time.
- Prices and payment. All prices are in US dollars. Payments are processed by Stripe. Applicable sales tax, if any, is calculated and shown at checkout. If a payment fails, we may pause the athlete's sessions until it is resolved.
- Automatic renewal. Monthly plans renew automatically every month, on the same date and at the price shown at sign-up, until cancelled. You can cancel at any time from the customer portal (link in the website footer) or by emailing us before the next billing date. Cancellation takes effect at the end of the paid month. We will email you at least 30 days before any price change.
- Conduct. Athletes must follow coach instructions and respect staff and other players. We may remove an athlete for unsafe or disruptive behavior; in that case, unused sessions of the current month are not refunded.
- Schedule changes. We may cancel or reschedule a session for weather, safety or staff reasons; cancelled sessions are rescheduled or credited.
- Electronic signature. Typing your full legal name and checking the boxes at registration is your electronic signature and has the same effect as a handwritten one under the federal E-SIGN Act and Florida's Uniform Electronic Transaction Act. We keep a record of your acceptance with the date, time and document versions.
- Governing law. These terms are governed by Florida law. Any dispute will be brought in the state courts located in Osceola or Polk County, Florida, unless the law requires otherwise.
- General. If any part of these terms is found unenforceable, the rest remains in effect. We may update these documents; the version you accepted is recorded with your registration, and changes do not affect it until you renew or re-register.
2. Refund Policy
- All sales are final. Cabrera Elite does not accept refunds of any kind after payment is made. This applies to Single Practice sessions, monthly plans, unused or missed sessions, and early cancellation or withdrawal.
- Cancelling a monthly plan: cancel before your next billing date to avoid the next charge; you keep access until the end of the paid month. Cancelling stops future charges but does not refund any amount already paid.
- Single Practice ($50): if you cancel at least 24 hours before the session, you may reschedule it.
- Our cancellations: if we cancel a session and cannot reschedule it, you receive a credit toward a future session.
- Free evaluation: a new athlete's first evaluation is free, so you can get to know the program before paying.

3. Assumption of Risk & Liability Waiver
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF CABRERA ELITE BASEBALL DEVELOPMENT USES REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD'S RIGHT AND YOUR RIGHT TO RECOVER FROM CABRERA ELITE BASEBALL DEVELOPMENT IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND CABRERA ELITE BASEBALL DEVELOPMENT HAS THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
Baseball training (throwing, hitting, catching, running, sliding, strength and conditioning work) carries inherent risks. These include being struck by a ball, bat or other equipment; collisions with other people or objects; falls; muscle, joint, arm and overuse injuries; uneven or wet surfaces; heat, sun, lightning and other weather; dehydration; and equipment failure. Injuries can be serious, can cause permanent disability, and in rare cases can be fatal. By accepting this waiver, the parent/guardian (or the athlete, if 18 or older) confirms that:
- the athlete is physically able to take part and has no condition that prevents safe participation, and they will tell the coaches about any change;
- they have read and understand this waiver and voluntarily assume all inherent risks of participation;
- on behalf of a minor athlete, as natural guardian and as allowed by section 744.301(3), Florida Statutes, they release and waive in advance any claim against Cabrera Elite Baseball Development, its owners, coaches and staff ("Released Parties") for personal injury, including death, or property damage resulting from the inherent risks of the activity, even if the Released Parties use reasonable care;
- on their own behalf (and for an athlete who is 18 or older), they release the Released Parties from claims arising from the inherent risks of participation and from the ordinary negligence of the Released Parties, to the extent permitted by Florida law, but not from gross negligence or intentional misconduct;
- they authorize staff to seek emergency medical care for the athlete if the guardian or emergency contact cannot be reached, and accept responsibility for the related medical costs;
- if any part of this waiver is found unenforceable, the rest remains in effect.
4. Privacy Policy
- Who we are. Cabrera Elite Baseball Development, Poinciana, FL. Contact: cabreraeliteprospect@gmail.com.
- What we collect. From the parent/guardian (or the athlete, if 18+): athlete name, date of birth and position; parent/guardian name, phone and email; emergency contact name and phone; selected plan; your typed signature; the date, time, language and document versions of your acceptance; and your photo/video choice. We do not collect precise location, and we do not collect health information other than what you tell us for safety.
- Children. Information about athletes under 18 is provided by their parent or guardian. We do not knowingly collect information directly from children under 13 and do not ask children to create accounts.
- Why. To register athletes, run sessions, contact families, handle billing and safety emergencies, keep records of signed agreements, and answer questions. We do not use this information for advertising.
- Who sees it. Only our coaching and admin staff and the service providers that help us operate: Stripe (payments; card data is handled by Stripe and never stored by us), Google (registration records are stored in Google Sheets), and our website host. Google Fonts may receive your IP address when the page loads. We may disclose information if required by law or to protect safety. We do not sell personal information and do not share it for advertising.
- Your device. The website stores only your language choice in your browser. It does not use advertising cookies.
- Retention. We keep registration, signed-waiver and payment records while the athlete is active and afterwards for as long as needed for legal, tax and safety purposes (generally up to 7 years), then delete or anonymize them.
- Security. Access is limited to staff who need it. No system is perfectly secure; if a breach affecting you occurs, we will notify you as required by Florida law.
- Your choices. You may ask to see, correct or delete your information, or withdraw the optional media permission, by emailing us. We may keep what the law requires us to keep.
- Changes. We will post updates on this page with a new version date.
5. Media Release (optional)
- Checking the optional media box allows Cabrera Elite to use photos and video of the athlete taken at sessions to promote the program on its website and social media. Under Florida law (section 540.08, Florida Statutes), for a minor this permission must come from the parent/guardian.
- We will not publish the athlete's full name, address, school or phone number without separate written permission.
- No payment is owed for this use. You can withdraw permission at any time by email; we will stop new uses and remove content we control within a reasonable time. Leaving the box unchecked does not affect participation.

1. Términos de servicio
- Quién registra. Un padre, madre o tutor legal debe registrar a todo atleta menor de 18 años y es responsable de la información entregada y de este acuerdo. El atleta de 18 años o más se registra por sí mismo.
- Sesiones. Los planes incluyen sesiones coacheadas al mes (Plan 2 Días: 8, Plan 3 Días: 12, Plan 5 Días: 20). Single Practice cubre una sesión. Las sesiones no usadas no se acumulan. Las sesiones se programan con el cuerpo técnico.
- Solo instrucción. Las tarifas se cobran exclusivamente por instrucción profesional de béisbol. El atleta puede estar en el campo o instalación solo durante su sesión coacheada programada; los planes no incluyen uso libre ni sin supervisión de campos, equipos o instalaciones.
- Salud y condición física. El padre/madre o tutor (o el atleta, si tiene 18+) debe informarnos de cualquier lesión, enfermedad o condición que pueda afectar el entrenamiento y debe consultar a un médico si tiene dudas. Los entrenadores pueden modificar o detener cualquier actividad por seguridad. Nuestro personal ofrece entrenamiento deportivo y acondicionamiento, no consejo ni tratamiento médico.
- Supervisión y recogida. Supervisamos a los atletas solo durante las sesiones programadas. Los padres/tutores son responsables de llevar y recoger al atleta a tiempo.
- Precios y pago. Todos los precios están en dólares de EE. UU. Los pagos los procesa Stripe. El impuesto sobre ventas aplicable, si lo hay, se calcula y se muestra al pagar. Si un pago falla, podemos pausar las sesiones del atleta hasta resolverlo.
- Renovación automática. Los planes mensuales se renuevan automáticamente cada mes, en la misma fecha y al precio mostrado al inscribirse, hasta que se cancelen. Puedes cancelar cuando quieras desde el portal del cliente (enlace en el pie de la página) o escribiéndonos antes de la próxima fecha de cobro. La cancelación surte efecto al final del mes pagado. Te avisaremos por correo al menos 30 días antes de cualquier cambio de precio.
- Conducta. Los atletas deben seguir las instrucciones de los entrenadores y respetar al personal y a otros jugadores. Podemos retirar a un atleta por conducta insegura o disruptiva; en ese caso, las sesiones no usadas del mes en curso no se reembolsan.
- Cambios de horario. Podemos cancelar o reprogramar una sesión por clima, seguridad o personal; las sesiones canceladas se reprograman o se acreditan.
- Firma electrónica. Escribir tu nombre legal completo y marcar las casillas en el registro es tu firma electrónica y tiene el mismo efecto que una firma manuscrita según la ley federal E-SIGN y la Ley Uniforme de Transacciones Electrónicas de Florida. Guardamos un registro de tu aceptación con fecha, hora y versiones de los documentos.
- Ley aplicable. Estos términos se rigen por las leyes de Florida. Cualquier disputa se presentará en los tribunales estatales ubicados en el condado de Osceola o Polk, Florida, salvo que la ley exija otra cosa.
- General. Si alguna parte de estos términos no fuera exigible, el resto sigue vigente. Podemos actualizar estos documentos; la versión que aceptaste queda registrada con tu inscripción y los cambios no la afectan hasta que renueves o te registres de nuevo.
2. Política de reembolso
- Todas las ventas son finales. Cabrera Elite no acepta reembolsos de ningún tipo después de realizado el pago. Esto aplica a las sesiones Single Practice, los planes mensuales, las sesiones no usadas o perdidas, y la cancelación o retiro anticipado.
- Cancelar un plan mensual: cancela antes de tu próxima fecha de cobro para evitar el siguiente cargo; conservas el acceso hasta el fin del mes pagado. Cancelar detiene los cargos futuros, pero no reembolsa ningún monto ya pagado.
- Single Practice ($50): si cancelas con al menos 24 horas de anticipación a la sesión, puedes reprogramarla.
- Cancelaciones nuestras: si cancelamos una sesión y no se puede reprogramar, recibes un crédito para una sesión futura.
- Evaluación gratis: la primera evaluación de un atleta nuevo es gratuita, para que conozcas el programa antes de pagar.

3. Asunción de riesgo y exención de responsabilidad
LEA ESTE FORMULARIO COMPLETAMENTE Y CON CUIDADO. USTED ACEPTA QUE SU HIJO MENOR PARTICIPE EN UNA ACTIVIDAD POTENCIALMENTE PELIGROSA. USTED ACEPTA QUE, AUN SI CABRERA ELITE BASEBALL DEVELOPMENT USA CUIDADO RAZONABLE AL OFRECER ESTA ACTIVIDAD, EXISTE LA POSIBILIDAD DE QUE SU HIJO RESULTE GRAVEMENTE LESIONADO O MUERA AL PARTICIPAR, PORQUE EXISTEN CIERTOS PELIGROS INHERENTES A LA ACTIVIDAD QUE NO PUEDEN EVITARSE NI ELIMINARSE. AL FIRMAR ESTE FORMULARIO USTED RENUNCIA AL DERECHO DE SU HIJO Y AL SUYO A RECLAMAR A CABRERA ELITE BASEBALL DEVELOPMENT EN UNA DEMANDA POR CUALQUIER LESIÓN PERSONAL, INCLUIDA LA MUERTE, A SU HIJO O DAÑO A LA PROPIEDAD QUE RESULTE DE LOS RIESGOS QUE SON PARTE NATURAL DE LA ACTIVIDAD. El entrenamiento de béisbol (lanzar, batear, atrapar, correr, deslizarse, fuerza y acondicionamiento) conlleva riesgos inherentes. Incluyen recibir un golpe de pelota, bate u otro equipo; choques con personas u objetos; caídas; lesiones musculares, articulares, del brazo y por sobreuso; superficies irregulares o mojadas; calor, sol, rayos y otras condiciones del clima; deshidratación; y fallas del equipo. Las lesiones pueden ser graves, causar discapacidad permanente y, en casos raros, la muerte. Al aceptar esta exención, el padre/madre o tutor (o el atleta, si tiene 18 años o más) confirma que:
- el atleta está físicamente apto para participar y no tiene condición que impida participar con seguridad, y avisará a los entrenadores de cualquier cambio;
- ha leído y entiende esta exención y asume voluntariamente todos los riesgos inherentes a la participación;
- en nombre de un atleta menor, como tutor natural y según lo permite la sección 744.301(3) de los Estatutos de Florida, libera y renuncia por adelantado a cualquier reclamo contra Cabrera Elite Baseball Development, sus dueños, entrenadores y personal ("Partes Liberadas") por lesión personal, incluida la muerte, o daño a la propiedad que resulte de los riesgos inherentes a la actividad, aun si las Partes Liberadas usan cuidado razonable;
- en su propio nombre (y por un atleta de 18 años o más), libera a las Partes Liberadas de reclamos derivados de los riesgos inherentes a la participación y de la negligencia ordinaria de las Partes Liberadas, en la medida permitida por la ley de Florida, pero no de negligencia grave ni conducta intencional;
- autoriza al personal a buscar atención médica de emergencia para el atleta si no se puede contactar al tutor o al contacto de emergencia, y acepta la responsabilidad por los costos médicos relacionados;
- si alguna parte de esta exención no fuera exigible, el resto sigue vigente.
4. Política de privacidad
- Quiénes somos. Cabrera Elite Baseball Development, Poinciana, FL. Contacto: cabreraeliteprospect@gmail.com.
- Qué recopilamos. Del padre/madre o tutor (o del atleta, si tiene 18+): nombre, fecha de nacimiento y posición del atleta; nombre, teléfono y correo del tutor; nombre y teléfono del contacto de emergencia; plan elegido; tu firma escrita; fecha, hora, idioma y versiones de los documentos que aceptaste; y tu elección sobre fotos/videos. No recopilamos ubicación precisa ni información de salud más allá de lo que nos indiques por seguridad.
- Menores. La información de atletas menores de 18 años la entrega su padre, madre o tutor. No recopilamos a sabiendas información directamente de menores de 13 años ni les pedimos crear cuentas.
- Para qué. Para registrar atletas, realizar las sesiones, contactar a las familias, gestionar cobros y emergencias, conservar el registro de los acuerdos firmados y responder consultas. No usamos esta información para publicidad.
- Quién la ve. Solo nuestro personal técnico y administrativo y los proveedores que nos ayudan a operar: Stripe (pagos; los datos de la tarjeta los maneja Stripe y nunca los almacenamos), Google (los registros se guardan en Google Sheets) y el proveedor de alojamiento del sitio. Google Fonts puede recibir tu dirección IP al cargar la página. Podemos divulgar información si la ley lo exige o para proteger la seguridad. No vendemos información personal ni la compartimos con fines publicitarios.
- Tu dispositivo. El sitio solo guarda en tu navegador la elección de idioma. No usa cookies publicitarias.
- Conservación. Conservamos los registros de inscripción, exenciones firmadas y pagos mientras el atleta esté activo y después el tiempo necesario por razones legales, fiscales y de seguridad (por lo general hasta 7 años); luego los eliminamos o anonimizamos.
- Seguridad. El acceso se limita al personal que lo necesita. Ningún sistema es perfectamente seguro; si ocurre una brecha que te afecte, te avisaremos como exige la ley de Florida.
- Tus opciones. Puedes pedir ver, corregir o eliminar tu información, o retirar el permiso opcional de medios, escribiéndonos. Podemos conservar lo que la ley nos obligue.
- Cambios. Publicaremos las actualizaciones en esta página con una nueva fecha de versión.
5. Autorización de uso de imagen (opcional)
- Al marcar la casilla opcional, permites que Cabrera Elite use fotos y videos del atleta tomados en las sesiones para promocionar el programa en su sitio web y redes sociales. Según la ley de Florida (sección 540.08 de los Estatutos de Florida), en el caso de un menor este permiso debe darlo el padre/madre o tutor.
- No publicaremos el nombre completo, dirección, escuela ni teléfono del atleta sin un permiso escrito aparte.
- No se debe pago alguno por este uso. Puedes retirar el permiso en cualquier momento por correo; dejaremos de hacer nuevos usos y retiraremos el contenido que controlemos en un plazo razonable. Dejar la casilla sin marcar no afecta la participación.
